Technically, it probably would be, which highlights the inanity of these laws.

Restricting worker's ability to find new jobs is not a nice gesture. It's opressive, and also may be illegal.

While this doesn't affect employees' ability to find jobs as much, it would affect their pay (as there would be no bidding wars over employees wanted by both companies).
