The article says some employees were assaulted. Wouldn’t it make more sense to arrest the perpetrators than sue the company ?? Not saying this is wrong but it seems like the perps are still out there.

This is a “yes and” situation. In addition to the criminal charges of sexual assault it is also the the legal responsibility for employers to keep their house clean so to speak and take seriously allegations of discrimination and assault.

I think when cases like this come up there’s always arguments like “why should it be the responsibility of the school or company, this is a police matter.” It makes sense to think about it this way if your view of the law is “police, courts, and prison.” But it turns out “uniformed officers with guns” doesn’t scale.

Like I wish I was joking but if I went to the police (and they magically took them all seriously) for every single time I’ve been harassed, had wildly inappropriate sexual comments thrown my way, or been casually discriminated against at work I would do nothing except show up to court hearings. There is nothing to gain and everything to lose by reporting it — the only changes that have made any difference in my life has been top down cultural shifts. It’s one of those thing that you simultaneously just have to accept as “that’s just how the world is right now” as an individual while working on changing it as a collective if you don’t want to drive yourself mad.


If the company doesn't take it seriously your next available escalation is to take them to court. Generally these settlements include firing the perpetrators from what I've seen


It might be a both and rather than an either or. Those would probably be separate lawsuits against the individuals.
